We facilitate the connection between your user-provided Email Service Provider (ESP) APIs (such as Amazon SES, Mailgun, SendGrid, etc.) and your recipients. Our service includes AI-powered content generation, campaign management, and analytics tools.

2. User Obligations & API Usage

• You must provide valid API credentials from supported third-party providers.
• You are responsible for all costs, limits, and compliance requirements imposed by your chosen API provider (e.g., AWS SES Sandbox limits).
• You must not use Mailhostly to send spam, unsolicited bulk email, or any content that violates the CAN-SPAM Act or GDPR.

3. AI Content Assistance

Our platform includes AI features to assist in email creation. While we strive for high-quality output, Mailhostly does not guarantee the accuracy, legal compliance, or effectiveness of AI-generated content. You are solely responsible for reviewing all content before sending.

4. Prohibited Content

You agree not to use the service to send content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable. We reserve the right to suspend accounts that trigger high complaint rates from external API providers.

5. Privacy & Data

We process your data and subscriber lists solely to provide the service. We do not sell or rent your subscriber data. For details on how we handle information, please refer to our Privacy Policy.

6. Limitation of Liability

Mailhostly is provided "as is." We are not liable for any delivery failures caused by third-party API providers, account suspensions on external platforms, or loss of data resulting from your configuration.

7. Modifications to Service

We reserve the right to modify or discontinue the service (or any part thereof) with or without notice. Pricing for premium features is subject to change with 30 days' notice.
